مسائل الفروق المتعلقة بقواعد النكاح والطلاق وما جانسها من فروق القرافي (ترتيب البقوري)

Abstract

هذا البحث عبارة عن دراسة لقواعد متعلقة بالنكاح والطلاق من فروق الإمام القرافي بترتيب الإمام البقوري ، و هي كالآتي: القاعدة الأولى: حول الفرق بين ما يقر من أنكحة الكفار وما لا يقر . أما الثانية: فهي حول نكاح الأحرار العبيد. أما الثالثة: فهي حول الفرق بين الحجر على النساء في الأبضاع وعدم الحجر عليهن في الأموال ا. أما الرابعة : فهي حول الفرق بين ما ينعقد به النكاح وما ينعقد به البيع. أما الخامسة: فهي حول الفرق بين إنظار المعسر بالدين وعدم إنظار المعسر بالنفقة. أما السادسة: فهي حول الفرق بين الثمن في البيع ، والصداق في النكاح. أما السابعة :فهي حول الفرق بين المتداعيين من الزوجين في متاع البيت، وبين المتداعيين في غير ذاك . أما الثامنة : الفرق بين الوكالة في البيع والولاية في النكاح.

This research is a study of the rules related to marriage and divorce among the differences of Imam al-Qarafi in the order of Imam al-Baquri, and they are as follows: The first rule: about the difference between what is approved of the marriage of the infidels and what is not approved. and the second: It is about the free marriage of slaves. As for the third: It is about the difference between the stone on women in private and not the stone on them in the money.
