الشفعة وأثرها على الملكية العقارية الخاصة في التشريع الجزائري

Abstract

يعتبر موضوع قواعد تسيير المحفظة العقارية الخاصة التابعة للدولة من المواضي ذات الأهمية الكبيرة في وقتنا الراهن خاصة على الصعيدين الاجتماعي والاقتصادي، لهذا كفل المشرع الجزائري من خلال أحكام القانون 90-30 المتعلق بالأملاك الوطنية للدولة آليات بهدف تسيير واستغلال هذا الصنف من العقارات، والمتمثلة أساسا في التصرفات الناقلة للملكية وهي البيع والتبادل، والتصرفات غير الناقلة للملكية وهي الإيجار والتخصيص والامتياز.
