Abstract

تناولت الدراسة موضوع المسكوت عنه وعلاقته بالسنة والبدعة عند الإمام الشاطبي دراسة تأصيلية تطبيبقية وبعد ان تناولت حيثيات الموضوع ومفردات البحث وكذا التعريف الامام الشابطبي خلصنا الى جملة من النتائج من اهمها أن المسكوت عنه والمتروك من خلال حديث أبي ثعلبة الخشني ينبغي وجود فرق بينهما لاعتبار الترك ليس نهيا. كما انه لا يعد من قبيل السنة عند الفقهاء لأنه لا يصلح دليل على التبديع لأن من معاني السنة عندهم مقابلة للبدعة . أن تروك النبي صلى الله عليه وسلم منها ما هو من أمور الدين ومنها ما هو من أمور الدنيا فما كان في الدنيا فهو جائز ما لم يدل دليل على أنه منهي عنه وما كان في الدين فإن كان الترك لأصل العمل فهو البدعة الحقيقية وإن كان لوصف العمل فهو البدعة الإضافية .
