الأحاديث النبوية بين إشكالية الفهم ومزالق التطبيق

Abstract

يعالجُ البحث موضوع التعامل مع الأحاديث النبوية استنباطاً وتنزيلاً، من خلال رصد مثارات الخلل في فهمِ الأحاديث النبوية والوقوف على مزالقِ تطبيقها، بغية الوصول إلى الحكم الشرعي الصحيح دون إشكالٍ في الفهم أو مزلقٍ في التطبيق. وفي إطار هذه المعالجة تناول البحث العناصر الآتية: المشترك اللفظي،وحروف المعاني، وتعارض العموم والخصوص،والإطلاق والتقييد، كمثاراتٍ للخلل في الفهم، ثم إغفال أحوال وأزمنة وأمكنة واقعة التنزيل. وتجسيدًا لهذه المعالجة تضمَّنت الدراسة نماذج في أحاديث التعايش وبيَّنت الزلل في تطبيقها

The paper deals with the issue of dealing with the hadiths in deduction and download, by monitoring the issues of imbalance in the understanding of the hadiths and identifying the pitfalls of their application , in order to reach the correct legal ruling without any problem in understanding or sliding in the application . Within the framework of this treatment, the research dealt with the following elements: the verbal commonality, the truth and metaphor, the letters of meanings, and the opposition of the general and the specifics, the release and the restriction as causes for the defect in the understanding. Misrepresentation of the event of revelation, neglecting the conditions, times and places of the event of revelation, neglecting the intentions of the taxpayers, lack of balance between conflicting interests and evils, and neglecting the means of applying the hadith as pitfalls of implementation. To embody this treatment, the study included models in conversations of coexistence and showed the flaws in their application
