أحكام الإهمال في الفقه الإسلامي

Abstract

تناولنا في هذه الدراسة التي تحمل عنوان " أحكام الإهمال في الفقه الإسلامي ( دراسة نماذج)، مفهوم الإهمال وحكمه وأدلة عدم مشروعيته، ثم تعرضنا لنماذج من الإهمال فتناولنا الإهمال بين الزوجين وبالتخصيص الإهمال من جهة الزوجة، والإهمال من جهة الطبيب ثم إهمال المال العام،. اعتمدنا في دراستنا على المنهج التحليلي لمناسبته في تحليل آراء الفقهاء وعرض مختلف الأدلة من الكتاب والسنة. وقد توصلنا خلال بحثنا للموضوع لنتائج أهمها: أن الإهمال ظاهرة خطيرة، تعرض صاحبها لمختلف العقوبات من ضمان وتعزير ودية وغيرها من الأحكام، وأنه تترتب مسؤولية عظمى على عاتق كل مهمل. أما أهم التوصيات التي يمكن الخروج با: هي أن نسعي وتحرص على التوعية والتحسيس بخطورة هذه الظاهرة، كما يجب الإهتمام بتربية النشء على تحمل المسؤولية منذ الصغر لتجنب مثل هذه الأفعال.

In this study titled “Rulings of Neglect in Islamic Jurisprudence (Study of Models), we dealt with the concept of negligence, its ruling and evidence of its illegitimacy. Then we presented examples of neglect. We dealt with neglect between spouses and specifically neglect on the side of the wife, neglect on the part of the physician, then neglect of public money. In our study, we relied on the analytical method for its relevance in analyzing the opinions of the jurists and presenting various evidence from the Qur’an and Sunnah. During our discussion of the issue, we reached the most important results: that neglect is a dangerous phenomenon, subjecting its owner to various penalties such as guaranteeing, discretionary and other provisions, and that a great responsibility arises on the shoulders of every negligent. As for the most important recommendations that can be made: That we strive to raise awareness of the danger of this phenomenon, and attention must be paid to educating young people to take responsibility from an early age to avoid such actions.
