الوصاية الإدارية وأثرها على استقلالية الجماعات الإقليمية في الجزائر

Abstract

تُقدِّم هذه الدراسة تصوُّراً شاملاً لواقع رقابة الوصاية الإدارية على الجماعات الإقليمية في الجزائر، مبرزة جهود المشرع في تكريس وإرساء استقلالية الجماعات الإقليمية، وتدعيم أُسُس اللامركزية الإدارية، والديمقراطية التشاركية في التسيير المحلي؛ فضلاً عن الكشف عن مختلف السّلبيات والاختلالات التي كانت ومازالت تعترض مسعى المشرع، سواء من النواحي القانونية أو الإدارية، وتقديم بعض الحلول والرُّؤى النقدية والتصويبية للعديد من النقاط الحسَّاسة في مجال الرقابة على الجماعات الإقليمية، ونمط التسيير المحلي إدارياً ومالياً، بما يساير الحكامة الإقليمية الرشيدة.

This study gives a global vision of the reality of the control of the administrative supervision of the territorial collectivities in Algeria, highlighting the efforts of the legislator to consecrate and consolidate the independence of these collectivities, and to reinforce the bases of administrative decentralization and participatory democracy in local administration. In addition to revealing the different negatives and imbalances that still intercepted this independence, whether from a legal or administrative point of view, and providing critical and corrective solutions and visions for many sensitive points in the area of community monitoring territorial, and the administrative and financial scheme of local management, in line with good local governance.
