Abstract

يعتبر تنفيذ قرار التحكيم أهم مرحلة من مراحل العملية التحكيمية، فبصدور قرار التحكيم يفترض أن يتم طرحه من قبل الطرفين بطريقة ودية ولكن يمكن أن يكون لأحد الطرفين الذين لم ينجحوا في تطبيق الحكم الأبري، جعل المحطة الأخرى طرفًا في الإعدام القسري بناءً على طلب أحدهم إلى السلطات القضائية بعد رفع نظام الملاحقة القضائية أو 'نظام لأمر التنفيذ ويتبع الإجراءات المنصوص عليها في القانون، يقوم القاضي بعد ذلك بمد رقابة حكم التحكيم والتأكد من أنه حكم وليس مخالفاً للنظام العام، ثم قرار بقبول أو رفض.
