آراء الشيخ الترابي الفقهية

Abstract

يعد الاجتهاد من بين الموضوعات الفقهية التي حظيت بالدراسة، والمناقشة من قبل الفقهاء، وبعض المعاصرين خاصة.حيث نجد الشيخ حسن عبد الله الترابي اجتهد في بعض المسائل التي لها علاقة بالمرأة وشؤونها في الفقه، وبيان رأيه في هذه المسألة، ودحضها من قبل الفقهاء، وهذا راجع لعلاقة الموضوع وتعلقه بأبواب فقهية متعددة، ومتنوعة، وبيان رأي الفقهاء في المسألة التي ناقشها الترابي، كما تم اختيارنا لهذا الموضوع ،رغبتنا في التعرف على الإمام الترابي واجتهاداته، رغبتنا كذلك في معرفة موقف العلماء من اجتهاداته موافقة له أم مخالفة، ومن الأهداف الحصر اجتهادات الإمام الترابي التي أثارت جدلا، مقارنتها بأقوال الفقهاء والتوصل إلى الراجح فيها، ومنهج دراستنا الذي اتبعناه لسرد موضوعنا هو المنهج الوصفي التحليلي، ومن أهم الدراسات السابقة آراء الترابي من غير تكفير ولا تشهير د. محمد بن المختار الشنقيطي، مركز الراية للتنمية الفكرية{دمشق، جدة}،ط1(2006م)، الرد المبين على الشيخ الترابي فيما أنكره من الدين، محمد عبد الحيلم محمد، ط1(1430ه،2009م)، واتبعنا خطة قوامها مقدمة، وأربعة مباحث، وكل مبحث يتضمن ثلاثة مطالب، وخاتمة.
