ضوابط حل المجلس الشعبي الوطني وانعكاساته في التشريع الجزائري

Abstract

إن حل المجلس الشعبي الوطني هو ميزة من مميزات التظام البرلماني, ومعناه قيام السلطة التنفيدية بوضع حد للفترة التشريعية للمجلس قبل إنتهاء فترته القانونية. نظم الدستور الجزائري الية حل المجلس التشريعي من خلال تكريسه دستورياً, وهدا سعياً من من اجل الحفاظ على التوازن بين السلطة التنفيدية والسلطة التشريعية. قد يحل المجلس الشعبي الوطني تلقائيا وهدا يكون في حالة رفض برنامج الحكومة للمرة الثانية على التوالي, وقد يكون بموجب مرسوم رئاسي يصدر عن رئيس الجمهورية وهدا مايعرف بالحل الرئاسي, وباعتبار ان السلطة التشريعية تلعب دوراً مهماً في الحفاظ على الاستقرار السياسي للدولة عمل المشرع على إرساء ضمانات من شانها تؤدي الى عدم التعسف في اللجوء الى هاته الالية .
