المصطلح الأصولي عند ابن عاشور

Abstract

يعتبر ابن عاشور كسْبًا حقيقيًّا للعلوم الإسلامية، بفضل نبوغه في العلوم الشّرعية واللّغوية، وإدراكه لفلسفة التّشريع الإسلامي، فضْلاً عن انفتاحه على الواقع وما يزخر به من أحداثٍ، وهذا الكسْبُ امتدّت روافده لتشمل الجوانب التّجديدية في شتّى المجالات من مجالات العلوم الشّرعية، وقد احتلت قضيّة المصطلح في فكر الأصوليين أهمّية بالغة، ارتكزت عليها الدّراسة الأصولية، فلا يكاد الأصوليّ يتناولُ أيّ قضيّة بالدّراسة والبحث، إلاّ بعد تحديد المصطلح الذي تدور عليه القضية كلّها، و ما القواعد الأصولية التي يطعّمها الأصوليّ بتلكم المصطلحات إلاّ انعكاساتٌ تدلّ على رأيه في مسائل الفروع الفقهية، وما الدّلالات المقاصدية إلا مرغّباتٌ في الامتثال بمجموع تلكم القوانين الفقهية، تأتي هذه الدراسة لتكشف عن منهج الدّراسة المصطلحية، ومقاصدها من وجه، ثمّ لرصد الحسّ الأصولي عند ابن عاشور.

Il est un véritable rédempteur de la science islamique, grâce à son ingéniosité dans les sciences juridiques et linguistiques, sa conscience de la philosophie de la législation islamique, son ouverture à la réalité et à ses événements, et sa richesse a été étendue pour inclure des aspects novateurs dans divers domaines des sciences juridiques; parmi eux : L’aspect du terme étude où la question du terme est d’une importance capitale; L’étude originale est basée sur elle, et presque fondamentaliste ne traite d’aucune question d’étude et de recherche, sauf après avoir défini le terme dans lequel toute la question est concernée, et les règles fondamentalistes que les fondamentalistes obéissent aux termes ne reflètent que son opinion sur les questions des branches doctrinales, et les connotations ne sont que des désirs de se conformer à la somme de laquelle le doctrinal .

He is also a member of the Council of the Islamic Republic of Iran, which is the only country in the world to have the right to do so. Based on the fundamentalist study, fundamentalism is hardly dealing with any issue of study and research, except after defining the term in which the whole issue is concerned, and what fundamentalist rules are developed by fundamentalists with these terms are reflections that indicate his opinion on the issues of the doctrinal branches, and the connotations are only desires to comply with the sum of which the doctrinal laws are accumulated. This study comes to reveal the method of the term study, its purposes from the face, and then to observe the fundamentalist sense of Ibn Ashour.
