Abstract

بما أن الفكر المقاصدي هو فكر متبصر بالمقاصد ، والمقاصد تحافظ على تحقيق مصالح الناس العاجلة والآجلة، والمصالح هي الحقوق؛ فإن الفكر المقاصدي السليم هو الذي يكتشف الحقوق ، وهو الميزان الذي نزنها به، كما يحافظ على اكتسابها باعتبارها مصالح ضرورية أودعها الله في أحكامه. ولكي تحمي الشريعة الإسلامية حقوق الإنسان أو مصالحه الضرورية عملت على تشريع الأحكام التي توفر وجودها فهي تحفظها من جانب الوجود، وأحكام أخرى تصونها وتمنع الاعتداء عليها ، فهي تحفظها من جانب العدم.
