نهاية علاقة العمل في قانون العمل الجزائري

Abstract

ان العامل يمكن له بإرادته المنفردة انهاء العلاقة ألعمل وفقا لإجراءات قانونيه فيكفي بذلك توفر حالة مشروعة سواء عن طريق الاستقالة او طلب الاحالة على التقاعد او فسخ ألعقد كما يمكن ذلك ايضا للهيئة المستخدمة وفق اسباب خاصة بها سواء وفق لسبب تأديبي او اقتصاديي او نظرا لتقيد حرية العامل بعقوبة او قد تنتهي بطريقة غير شرعية نظرا لتعسف صاحب ألعمل ايضا هناك الحالات القانونية الاخرى التي تخرج عن ارادة طرفي هذه ألعلاقة مثل ألوفاة او ألعجز او انهاء النشاط القانوني، او القوة القاهرة، او الالغاء القانوني، او انتهاء مدة علاقة العمل، كل هاته الاسباب تجعل من سير علاقة العمل امر مستحيلا و بذلك تنتهي هذه العلاقة.

This can also be done for the employing agency according to its own reasons, whether according to a disciplinary or economic reason, or due to the restriction of the worker's freedom There are other legal cases that deviate from the will of both parties to this relationship, such as death, disability, termination of legal activity, force majeure, legal cancellation, or the termination of the work relationship, all of these reasons make The functioning of the business relationship is impossible, and thus this relationship ends.
