Abstract

إن الأوضاع التي عايشها الأحداث ولا يزالون يعيشونها إلى غاية يومنا هذا في مختلف أقطار العالم باتت لا تندر بالخير، نتيجة الانتهاكات المتزايدة لحقوقهم والاعتداءات والتجاوزات الواقعة عليهم، والظروف المزرية التي يمرون بها وارتفاع معدلات الجريمة في أوساطهم، مما أثار قلق حفيظة المجتمع الدولي نحو هذه الأوضاع ودفعه إلى البحث عن حلول للقضاء عليها أو محاولة تحسينها على الأقل، من أجل ضمان حياة أفضل لهم كونهم مستقبل الأمم والبشرية جمعاء، من خلال إقراره لمجموعة من الترسانات القانونية في محاولة منه صياغة نظام حماية مستقل وخاص. وعليه يأتي موضوع هذا البحث والموسوم بالعدالة الجنائية للأحداث لدراسة هذا النظام بالمقارنة مع بعض القوانين الأخرى، من أجل تسليط الضوء على الجهود التشريعية الدولية لاسيما الوطنية المبذولة ومدى نجاحها في توفير الحماية الجنائية اللازمة للأحداث سواء من السلوكيات الإجرامية والاعتداءات الواقعة عليهم أو المرتكبة من طرفهم، خاصة في ظل الخصوصية التي يتمتعون بها خلال فترة حداثتهم والتي تقتضي معاملتهم معاملة جنائية متميزة عن تلك المعهودة لدى الأشخاص البالغين وتتماشى والمصلحة الفضلى لهم.

Therefore, the subject of this research and the subject of criminal justice for juveniles is to study this system in comparison to a set of laws in order to shed light on the international legislative efforts, especially the national ones, and their effectiveness in providing criminal protection for juveniles, from both criminal behaviour and attacks committed against them, the singularity they enjoyed during their period of juveniles, which requires that they be treated in a criminal manner distinct from the familiar procedures in adults and fit the best interest of them.
