الحمـاية القانونية للتنوع البيولوجي في إطار التنمية الـمستدامـة

Abstract

تعرضت الدراسة لموضوع الحماية القانونية للتنوع البيولوجي في إطار التنمية المستدامة –دراسة مقارنة-، بحيث ركزت على الكشف عن الإطار القانوني لحماية التنوع البيولوجي، فتمت دراسة مختلف الآليات المستحدثة من قبل المشرع الجزائري والقانون المقارن بالموازاة مع ما تضمنته اتفاقية حماية التنوع البيولوجي من أحكام وقواعد. ولقد تضمنت الأطروحة جميع القواعد القانونية لحماية التنوع البيولوجي على المستوى الدولي والداخلي، سواء من حيث الإطار التصوري أو القانوني أو المؤسسي المتعلق بالحماية، ومدى تفاعل جميع التقنيات الإدارية والقانونية الأخرى في حماية مكونات وعناصر التنوع البيولوجي.

Résume L'étude du domaine de la protection juridique a été escposee a la diversité biologique dans l’état du développement durable, L’étude comparative là ou insiste sur la découverte à propos du cadre légal pour la protection de la diversité biologique, cela a fini l’étude de différents mécanismes actuels de la part du législateur algérien et la loi comparative en parallèle avec ce qui l’inclus l’accord de la protection de la diversité biologique de provisions et règles. Et la thèse a inclus toutes les règles juridiques pour la protection de la diversité biologique sur le niveau national et intérieur soit du cadre photographique ou statut légale ou le fondateur lie à la protection, à quel point toutes les rections administratives et autre juridique en protection des composants et élément de la diversité biologique.

Abstract: This study deals with the protection of the biological diversity within the frame of sustainable development. A comparative study we focused on showing the legal side for the protection of the biodiversity. So we studied the different machanisms used by Algerian legislator and the comparative law in line the provisions of the convetion on the protection of the biodiversity. This thesis has included all legal rules for the protection of biodiversity at the international and domestic levels either on the conceptual or legal framework or the institutional that relates to the protection and the extent to which all other administrative and legal techniques interact in protecting the components and elements of biodiversity.
