الإنابة القضائية دراسة مقارنة

Abstract

لقد تم في دراسة هذا الموضوع المعنون بالإنابة القضائية في المبحث التمهيدي منه دراسة مفهوم الإنابة القضائية وذالك بالتطرق إل تعريف الإنابة القضائية لغة واصطلاحا سواء الإصطلاح القانوني أو الشرعي، مع تمييزها عما يشابهها من مصطلحات قانونية قريبة من معناها وذكر الأنواع المتعلقة بالإنابة القضائية. أما المبحث الأول منها فقد درسنا فيه كل من الشروط الموضوعية والشكلية للإنابة القضائية وذالك من الجانب القانوني والشرعي مع البدأ ببيان أساس مشروعيتها باعتبارها إجراء استثنائي وتطرقنا في المبحث الثاني والأخير إلى الأثار القانونية المترتبة على أمر الإنابة القضائية،ويشمل ذلك الجهة المختصة بالرقابة على صحة إجراء الإنابة والجهة المختصة بإبطال أمر الإنابة إذا ماشابه عيب أو أخل بأحد الأحكام القانونية المتعلقة بإجراء التحقيق.

In the study of this topic entitled judicial delegation in the preliminary section, the concept of judicial delegation was studied by addressing the definition of judicial delegation in language and convention, whether legal or legal terminology, while distinguishing it from similar legal terms close to its meaning and mentioning the types related to judicial delegation. As for the first topic, we studied in it both the substantive and formal conditions for judicial delegation and that from the legal and legitimate side, starting with stating the basis of its legitimacy as an exceptional procedure. And the competent authority to revoke the proxy order if it is similar to a defect or in breach of one of the legal provisions related to conducting the investigation
