رجم الزاني المحصن

Abstract

هذا البحث طرح مسألة حد الرجم بالنسبة للزاني المحصن في الإسلام من خلال دراسة فقهية مقارنة انتظمت في ثلاث مباحث، الأول: ذكر فيه مقدمات للتعريف بمصطلحات البحث، و الثاني: تعرضنا فيه لأقوال المنكرين للرجم سواء باعتباره عقوبة شرعية مطلقا أو باعتباره حدا فقط، أما الثالث: فقد ذكرنا فيه أقوال المثبتين للرجم كعقوبة حدية شرعية مع ذكر القول المختار في المسألة، متوخين في ذلك كله الأدلة المعتبرة عند أهل العلم دون التفات إلى ما هو خارج عن سننهم في البحث والمناظرة.

This research raised the question of the limit of stoning for the adulterer who is fortified in Islam through a comparative jurisprudence study organized in three investigations, the first is mentioned in it introductions to the definition of the terms of the research, and the second: in which we subjected the words of the deniers to stoning either as an absolute lycher punishment or As a limit only, the third is: we mentioned the words of the stoning fixers as a legitimate marginal punishment, with the mention of the said chosen in the matter, seeking all of this, in which they seek evidence considered by the scholars without paying attention to what is outside their age in research and debate.
