تصرفات الصبي المميز بين القابلية للإبطال ومقتضيات أحكام الأهلية دراسة مقارنة

Abstract

تناولت هذه الدراسة موضوع يهتم له الكثير من الاسرة يحمل عنوان تصرفات الصبي المميز ومقتضيات الاهلية القابلة للبطلان وكان جاءت الدراسة مقارنة بين الشريعة الاسلامية والقانون المدني الجرائري والتعريج على ما جاء به قانون الاسرة وقد خلصت هذه الدراسة ألى ان تصرفات القابلة للبطلان ينظر اليها المشرع الجزائري من ناحية بطلانها وقابلية للنفع والدائرة بين النفع والضرر ، اما في الشريعة الاسلامية فقد توجه الفقهاء الى ان هذ التصرفات قد تبقى موقوفة بمقارنة الاهلية وسن التميز للصبي .

This study dealt with a topic of concern to a lot of the family titled the behavior of the privileged boy and the requirements of eligibility subject to invalidity. The study came as a comparison between Islamic law and the civil law and the explication of what was stated in the family law. This study concluded that the actions of a person subject to nullity are seen by the Algerian legislator on the one hand. Its invalidity, usability, and the circle between benefit and harm. As for Islamic law, the jurists have directed that these behaviors may remain suspended by comparing the eligibility and the age of distinction for the boy.
