إعــادة الإدماج الاجـتـماعي للـمحبـوسين

Abstract

لقد كان للعقوبة السالبة للحرية دور كبير العقابية في السياسة العقابية المعاصرة خاصة بعد التطور التاريخي لهدف العقوبة من مبدأ الانتقام والألم إلى مبدأ العلاج والإصلاح وبالتالي تأهيل وتقويم المحبوس وإعادة إدماجه في المجتمع، هذا ما سعت إليه التشريعات الوضعية الحديثة من بينها المشرع الجزائري الذي استحدث مجموعة من البرامج والأساليب سواء داخل أو خارج المؤسسة العقابية التي من شأنها أن تهذب السجناء وتقويم سلوكاتهم وتهيئتهم من جديد للاندماج في المجتمع، وهذا كله نجد أن الشريعة الإسلامية قد أقرته من حيث الأصل، وإن اختلفت التسميات والأنظمة.

And all of this, we find that the Islamic Sharia has been approved by the origin, even if the nomenclature and regulations differ.
