الحماية الجزائية للعامل القاصر

Abstract

تجمع كافة الدراسات الطبية والاجتماعية والنفسية الي ان الجوء القصر المبكرالى العمل خاصة في المهن والاعمال الخطيرة ينجم عنه الاضرارالبالغ بالصحة البدنية والنفسية للعامل القاصر وحرمانه من الحصول على قدر كاف من التعليم . وتشير دراسات المنظمات الدولية على وجود علاقة واضحة بين عمل الاطفال المبكر وانتشار الامية. ان الفقر يدفع بملايين القصر على مستوى العالم و خاصة دول العالم الثالت الى العمل لكسب المال اللازم لاطعام انفسهم و اسرهم . لذلك كان لزام على المشرع ان يضع تشريعات وقيود خاصة على تشغيل القصرو حماية جزائية تعاقب على الاخلال باحكامها لتخفيف وطاة العناء والتعب على هؤلاء القصروتقديم لهم حماية من بطش استغلال ارباب العمل وتتمثل هذه القيود في الترخيص الولي الشرعي و تحديد سن تشغيل القاصر و الحجم الساعي للعمل واوقاته اما القيد الرابع فيتمثل في الاعمال التي يحظر تشغيل القاصرفيها.
