التجديد الفقهي عند الشيخ محمد الغزالي

Abstract

الحمد لله وكفى والصلاة والسلام على المصطفى سيدنا ومولانا محمد –عليه أفضل الصلاة وأزكى التسليم- الحمد لله الذي أكرمنا بخير كتاب أُنزِل، وخصنا بخير نبي أُرسل، بلغ الرسالة وأدى الأمانة، ونصح الأمة، فصلاة الله وسلامه عليه وعلى آله وصحبه أجمعين. أما بعد أما معنى التجديد في الاصطلاح ينصب على ثلاث محاور وهي: • إحياء ما أندرس من معالم السنن وحمل الناس على العمل بها. • قمع البدع والمحدثات وتنقية الإسلام مما علق فيه من أوضار الجاهلية. • تنزيل الأحكام الشرعية على ما يجد من وقائع ومعالجتها من هدي الوحي. معنى الفقه يتوقف على عدة معاني منها الفهم والعلم. والمعنى العام للفقه في الشريعة هو العلم بالأحكام الشرعية المكتسبة من أدلتها التفصيلية، ونجد الغزالي لما أورد نماذج لأحكام المرأة غيْر بهذا النظرة الثاقبة لما كان خالد بأذهان العرب لبعض الأحكام،كزعمهم بأن صوت المرأة عورة فقد بين أن هذا لا أساس له من الصحة ، ولقد عدْ الغزالي أعمال شتى ينبغي للمرأة أن تقوم بها، كما لم يغفل عن مجال الطب الذي قد يكون أحوج إلى المرأة من الرجل. دون أن يغفل عن عملها الأسمى في بيتها وداخل أسرتها وهو أن تكون ربت بيت ، فالمرأة الجهول التي لم تتعلم فلن تنشئ إلا جيل أسوء وعندها لا حاجة للمجتمع لجيل كهذا.
