الإجراءات الخاصة للتحري في جرائم مكافحة الفساد

Abstract

عرفت جرائم الفساد في وقتنا الحالي تطورا كبيرا ساهم في انتشارها على نطاق أوسع وهذا بفعل عدة عوامل مساعدة من بينها الاعتماد على وسائل التكنولوجيا. وأمام هذه المتغيرات أصبحت أساليب البحث والتحري التقليدية التي يلجأ اليها ضباط الشرطة القضائية غير مجدية و غير كافية للتصدي لها وردع مرتكبيها . لذا كان لابد من انتهاج أساليب جديدة تتماشى وطبيعة التقنية المستعملة في هذه الجرائم الخطيرة، شرط أن تتقيد هذه الوسائل بضمانات لحماية حقوق الانسان و تحترم حريته وكرامته . لهذا واستنادا للاتفاقيات الدولية التي وقعتها الجزائر كان لابد عليها من استحداث نصوص قانونية جديدة تنص على اعتماد اجراءات خاصة للبحث والتحري عن جرائم الفساد، وبناءا عليه يمكن اللجوء الى التسليم المراقب والترصد الالكتروني ، الاختراق على النحو المناسب وبإذن من السلطة القضائية المختصة.

Corruption crimes have largely increased nowadays, which contributed to their spread on a wider scale. This is due to several contributory factors, including reliance on technology. Faced with these changes, the traditional search and investigation methods that the judicial police officers resort to have become useless and insufficient to prevent these crimes and deter their perpetrators. Therefore, it was necessary to adopt new methods consistent with the nature of the technology used in these serious crimes, provided that these methods guarantee the protection of human rights and the respect of their freedom and dignity. Therefore, and based on the international conventions signed by Algeria, it had to develop new legal texts stipulating the adoption of special procedures for searching and investigating crimes of corruption, and accordingly, it is possible to resort to controlled delivery and electronic surveillance, and appropriate penetration with permission from the specialised judicial authority.
