ضمانات الإستثمار الأجنبي المباشر في ظل الاتفاقيات الثنائية

Abstract

يسلط هذا البحث الضوء عل العديد من المواضيع الهامة المتعلقة بطرق استقطاب المستثمر الأجنبي من خلال اتفاقيات ثنائية التي تكفل عدة ضمانات حيث تلعب اتفاقيات حماية الاستثمارات دورا مهما في تطوير النظام القانوني للاستثمارات الدولية، ووضعنا كل هذا في الأطر القانونية المناسبة له، من خلال النص عل القوانين والاتفاقيات الثنائية التي تكفل الضمانات، وذلك من خلال مقدمة تطرقنا من خلالها لإشكالية وأهمية الدراسة وتعريف بالموضوع لنليها بفصلين تطرقنا، في الأول إلى مفهوم الاستثمار الأجنبي المباشر وعلاقته بالاتفاقيات الثنائية، وفي الفصل الثاني دور الاتفاقيات الثنائية في حماية وضمان الاستثمار الأجنبي المباشر، متمثلا في الضمانات المالية والتشريعية والقضائية وكذا تطبيقات تلك الضمانات في الاتفاقيات الثنائية في الجزائر، وختمنا بحثنا بخاتمة تطرقنا فيها للنتائج والتوصيات التي تخص البحث

This research sheds light on many important issues related to methods of attracting foreign investors through bilateral agreements that guarantee several guarantees, as investment protection agreements play an important role in developing the legal system for international investments and we have put all this in the appropriate legal frameworks for it, through the text of laws and agreements. Bilateralism that guarantees guarantees, through an introduction, through which we touched on the problematic and importance of the study and defined the topic to be followed by two chapters, in the first about the concept of foreign direct investment and its relationship to bilateral agreements, and in the second chapter the role of bilateral agreements in protecting and ensuring foreign direct investment, represented in financial and legislative guarantees And judiciary, as well as the applications of those guarantees in bilateral agreements in Algeria, and we concluded our discussion with a conclusion, in which we touched upon the findings and recommendations of the research.
