دور السلطات الثلاثة في محاربة الفساد

Abstract

هدفت هذه الدراسة إلى التعرف على دور السلطات الثلاث في مكافحة الفساد في التشريع الجزائري، حيث تم الاعتماد بشكل أساسي على المنهج الوصفي التحليلي لمعالجة الموضوع، وذلك بتحليل مختلف النصوص التشريعية والتنظيمية، الدولية والوطنية، المتعلقة بمكافحة الفساد في العالم بوجه شامل وفي الجزائر بوجه خاص، وقد تم تقسيم الدراسة إلى بابين وكل باب تم تقسيمه إلى أربعة فصول. وقد توصلت الدراسة إلى نتيجة عامة مفادها هيمنة السلطة التنفيذية على باقي السلطات مما أثر سلبا على دورها في مكافحة الفساد.

This study aimed to identify the role of the three authorities in fighting corruption in the Algerian legislation, Depending on the descriptive analytical method, by analyzing the various legislative and regulatory texts, international and national, related to combating corruption in the world in a comprehensive way and in Algeria in particular, The study was divided into two sections , and each section was divided into four chapters. The study reached a general result that the executiveauthority dominates the rest of the authorities, which negatively affects its role in fighting corruption.
