اجتهادات فقهاء المالكية في حفظ الحيوان

Abstract

من بين اجتهادات المالكية في حفظ الحيوان، أنهم جعلوا نفقته واجبة على مالكه بل وأجبروه على إخراجه من ملكه إن امتنع عنها، كما أنهم أيضا جوزوا التيمم إذا خيف عليه العطش، وجوزوا الاستسقاء للبهائم. وكذلك أوجبوا الضمان على من اعتدى علي الحيوان ،ومنعوا أيضا خصاء الخيل لأنه يضعف قوتها ويقطع نسلها، كما أنهم أيضا منعوا التفرقة بين البهيمة وولدها في البيع ،وكرهوا الصيد لغير حاجة لما فيه من التلهي.

Among the endeavors of the Maliki in preserving the animal, they made it obligatory for its owner and even forced him to take it out of his possession if he abstained from it, and they also allowed tayammum if he feared thirst, and they permitted the watering of animals. Likewise, they imposed the guarantee on those who assaulted the animal, and they also prevented castration of the horse because it weakens its strength and cuts off its offspring, and they also forbade the distinction between a beast and its offspring when selling, and they disliked hunting without need for the distraction involved
