وقف النُّقود واستثمارها

Abstract

تناول هذا البحث موضوع وقف النقود واستثمارها دراسة مقارنة بين الفقه الإسلامي والقانون الوضعي، إذ أجاب على الإشكاليات التالية: ما المقصود بوقف النُّقود؟ وماهي الصُّور التي يقُوم عليها؟ وما مدى مشروعية وقف النُّقود في الفقه الإسلامي والقانون الوضعي؟ وما هي أساليب استثمار وقف النُّقود وضوابطه؟ وما المخاطر النَّاجمة عنها؟ وقسم البحث إلى مبحث تمهيدي وثلاثة مباحث، المبحث التمهيدي بيَّن مفهوم الوقف وما يتعلق به، بينما عالج المبحث الأول: حقيقة وقف النقود، وأما المبحث الثاني: فتناول حكم وقف النقود، وأما المبحث الثالث: فتضمن كيفيات تسيير الأوقاف النقدية. وأهم النتائج المتوصل إليها: هي أن وقف النقود جائز ومشروع، ويعتبر آلية هامة لتمويل الاستثمار الوقفي، ومحاربة الفوائد الربوية المسببة للأزمات الاقتصادية، بناءً عليه يقدم هذا البحث جملة من التوصيات أهمها العمل على ضرورة إنشاء مؤسَّسات وقفية تكرِّس جهودها لتنمية استثمار وقف النُّقود، وكذا إعادة النَّظر في نصوص قانون الأوقاف الجزائري، وإضافة مواد أخرى خاصَّة بمجال وقف النُّقود الذي يعتمد على أحدث صيغ الاستثمار النَّاجحة في الوقت الحاضر.

This research dealt with the topic of stopping money and investing it in a comparative study between Islamic jurisprudence and positive law, as it answered the following problems: What is meant by stopping money? What are the pictures that are based on it? What is the legality of stopping the money in Islamic jurisprudence and positive law? What are the methods of investing and stopping money? What are the risks resulting from it? The research section was divided into an introductory topic and three sections, the introductory topic showed the concept of the endowment and what related to it, while the first topic dealt with the fact that the money was stopped, and the second topic: it dealt with the ruling on stopping the money, and the third topic: it includes the modalities for conducting the monetary endowments. The most important results reached are that stopping money is permissible and legitimate, and it is an important mechanism for financing endowment investment, and combating usurious benefits that cause economic crises. Accordingly, this research presents a set of recommendations, the most important of which is work on the need to establish endowment institutions that devote their efforts to the development of stopping money investment, as well as returning Examining the provisions of the Algerian Endowment Law, and adding other articles related to the endowment field that depend on the latest successful investment formulas at the present time.
