دور الجماعات المحلية في الحفاظ على النظام العام

Abstract

يقتصر الاختصاص في مجال الضبط الاداري على المستوى المحلي في الجزائر على سلطتين، تتجلى إحداهما في شخصية الوالي، والاخرى تتمثل في شخصية رئيس المجلس الشعبي البلدي. وهاتين السلطتين كغيرهما من سلطات الضبط الاداري توضع تحت تصرفهما العديد من الوسائل المساعدة في اتخاذ كل الاجراءات والتدابير المناسبة التي تضمن الحفاظ على النظام العام، لكون هذا الاخير ضرورة اجتماعية غايتها استقرار المجتمع وصيانته. إلا ان هذه السلطة مقيدة وتخضع لحدود فقد تعتدي على حق من حقوق الافراد المقررة قانونا ، وتعد الرقابة القضائية اهم ضمانة لحماية هاته الحقوق والحريات. وكذا رقابة الوصاية التي يمارسها الوالي على رئيس المجلس الشعبي البلدي.

The competence in the field of administrative control at the local level in Algeria is limited to two powers, One manifests itself in the personality of the governor, and the other is the personality of the head of the Municipal People's Assembly. These two authorities, like other administrative control authorities, put at their disposal many means to assist in taking all appropriate measures and measures that guarantee the preservation of public order, since the latter is a social necessity aimed at the stability and maintenance of society. However, this authority is restricted and subject to limits, as it violates a right of individuals legally established, and judicial oversight is the most important guarantee to protect these rights and freedoms. As well as monitoring the guardianship exercised by the governor on the head of the Municipal People's Assembly.
