الحماية القانونية والقضائية للملكية العقارية الخاصة في التشريع الجزائري

Abstract

يكفل الدستور الجزائري حماية للملكية العقارية الخاصة والحقوق العينية العقارية باعتباره أعلى هرم قانوني داخلي، وجسد المشرع هذه الحماية بقوانين عادية تتضمن قواعد قانونية موضوعية من أبرزها الأمر رقم 75-74 المؤرخ في 12/11/1975 المتعلق بإعداد مسح الأراضي العام وتأسيس السجل العقاري ، والذي تبنى بموجبه نظام الشهر العيني من أجل توفير حماية قانونية للملكية العقارية الخاصة، و قواعد قانونية إجرائية تشرف على تطبيقها السلطة القضائية ممثلة في القضاء المدني والقضاء الإداري والقضاء الجزائي ، ويرجع سبب تعدد صور الحماية القضائية لأهمية الملكية العقارية الخاصة ودورها في تحقيق استقرار المعاملات العقارية .

The Algerian Constitution guarantees the protection of private real estate and real property rights, as the highest internal legal hierarchy, and the legislator has embodied this protection by ordinary laws containing objective legal rules, in particular order NO 75-74 of 12/11/1975 that includes the establishing general survey and the establishment of the real estate registry. Under which the property advertising system was adopted to ensure legal protection of private property, and the procedural legal rules supervised by the judiciary represented in civil and administrative and criminal justice, owing to the multiplicity of forms of judicial protection, the importance of private property and its role in stabilizing real estate transactions.
