منهج ابن بيه في الفتوى

Abstract

تبعا للدور الكبير للفتوى والآثار المترتبة عليها، اخترت في هذه الدراسة فتاوى شخصية من الشخصيات التي لها وزنها العلمي والمعرفي؛ هو الإمام عبد الله بن الشيخ المحفوظ بن بيه. وقد حاولت هذه الدراسة الإجابة على هذا السؤال: هل لابن بيه منهج مستقل في الفتوى؟ أم أنه منهج قديم قلده وأضاف إليه إضافات؟؟. وللإجابة على هذه الإشكالية جاءت الدراسة متكونة من مدخل تمهيدي: في بيان مدلولات عنوان الرسالة؛ و ثلاثة أبواب؛ فالباب الأول في التعريف بابن بيه، والباب الثاني عقد لبيان خصائص منهج ابن بيه في الفتوى، والباب الثالث خصصته لدراسة نموذجية تطبيقية على مجموعة من فتاويه. وبعد الدراسة لمعالم منهج ابن بيه في الفتوى توصلت إلى مجموعة من النتائج أبرزها: - يتسم منهج ابن بيه في الفتوى بالتكامل المعرفي من حيث التنظير والتطبيق حيث يعمل منهجية السلف الصالح في التعامل مع النصوص الشرعية تلقيا وفهما وتنزيلا. - الفتوى المتوازنة هي المنضبطة بالإطار الشرعي نصوصا ومقاصد، وجزئيات وقواعد، والمراعية للواقع بكل تغيراته تنزيلا. وتلك هي أصول فتاوى الرعيل الأول. أهم مواصفات المفتي المؤهل: الإحاطة بمنهجية السلف الصالح في الفتوى. وفي الأخير أثارت الدراسة بعض المواضيع التي يكون البحث فيها خصبا حول الإمام عبد الله بن بيه. كجمع فتاويه ودراستها، ودراسة موضوع المقاصد عنده.

Regarding the great role of fatwa and its effects, I chose in this study personal fatwas for one among the personalities who have a scientific and cognitive weight; it is Imam Abdullah Bin Shaykh Almahfud Bin Bayyah. I tried via this study to find an answer to the following question: does Bin Bayyah have an independent approach in fatwa ? Or is he adopting an old one that he just imitated and added to? In order to answer the above problematic, the study was divided into a preface: to highlight the thesis title meaning; and three chapters; among which the first was dedicated to Bin Bayyah biography, the second to clarify the features of his approach in fatwa, whereas the third one was devoted to a model applied study on a number of his fatwas. After studying the features of Bin Bayyah’s approach in fatwa I came up with a set of results notably: - Bin Bayyah’s approach in fatwa is characterized by cognitive integration in terms of theory and practice in that it employs the righteous predecessors (or Salaf ) methodology in dealing with the shariah texts in receiving, understanding and applying on the ground. - the balanced fatwa is that which respects the provisions of shariah in terms of texts and maqasid , details and rules. It is also the one which observes the reality with all its changes when applied on the ground. Those are the first generation’s fatwas foundations. - the most important qualified mufti specifications: the methodology mastery of the righteous predecessors in fatwa. In the end, the study has raised some subjects which are likely to be of a great importance about Imam Abdullah Bin Bayyah, such as collection and study of his fatwas , as well as the study of the maqasid subject according to him
