حّل المجالس المحلية المنتخبة

Abstract

تختلف أنواع الرقابة الوصائية على المجالس المحلية بين رقابة على الأشخاص ورقابة على الأعمال واخطر أنواع الرقابة هي الرقابة على الهيئة ككل المتمثلة في إيقاف و حل المجلس المحلي التي انحصرت في ظل التعددية الحزبية في حل المجلس فقط ،والذي يعني إنهاء الوجود القانوني للمجلس المحلي قبل انتهاء المدة القانونية للعهدة مع بقاء الشخصية المعنوية للولاية أو البلدية قائمة، يلجأ لهاته الرقابة في حالة توفر الأسباب التي نصّ عليها المشرع حصراً في قانوني الولاية والبلدية ويتم حلّ المجلس بمرسوم رئاسي بناءً على تقرير من وزير الداخلية، يلجأ بعدها لتجديد المجالس المحلية وفقاً للأحكام التي جاء بها القانونين رقمي 11-10 و 07-12.
