المــــــــــــحاباة وأثــــــــــرها في الـــــــــعقود

Abstract

تناولت الدراسة موضوع أثر المحاباة في العقود دراسة فقهية مقارنة وذلك لأهميته وكان في مقدمة أهدافها معرفة أثر المحاباة على عقود المعاوضات والتبرعات و عقد الزواج ولقد فشت في المجتمع بصورة متسارعة، حتى غدت حديث المجتمع بكل أطيافه ومستوياته سواء أكان ذلك في المجالس الخاصة أو العامة وفي الصحافة والإعلام، والناس يعبرون عن عدم رضاهم عنها، بخاصة آثارها السلبية في الحياة الخاصة، فكان الوقوف على مفهوم المحاباة كي تتضح الصورة ولا يختلط بما التفضيل والتخصيص الذي هو من متطلبات الحياة .

This study discussed the subject of ¨ favoritism rules in personal transactions and affairs which a comparative jurisprudential study. Due to its significance. One of its main objectives is to examine the rules in personal transactions and affaire and their social and ethical effects. As it is known favoritism has spread and prevailed through society in accelerating fashion until it has become the talk of society with all its classes and levels whether in private or public setting even in news papers and media channels. consequently people are expressing increasingly their dissatisfaction with favoritism especially when they observe its damanging consequences on public and private life
