التنفيـذ المشترك للصفقـات العموميـة في إطار المرسوم الرئاسي رقم 15-247

Abstract

بالنظر إلى معطيات فنية وأخرى اقتصادية سمحت التشريعات المقارنة للمتعامل الاقتصادي المتعاقد مع الإدارة في إطار عقود الصفقات العمومية وتحت مسؤوليته، أن بمنح أحد الأشخاص (المناول) تنفيذ جزء من الصفقة في إطار عقد مناولة بعد إبلاغ المصلحة المتعاقدة. هذا وقد عنت التشريعات المقارنة بوضع الأطر القانونية التي تخضع لها المناولة. وتعتبر المناولة خيار استراتيجي لمختلف الفاعلين في الحياة الاقتصادية، سواء في القطاع العمومي أو في القطاع الخاص في إطار ما يعرف باقتصاد السوق. بالنظر إلى أهمية عقود الصفقات العمومية في الحياة الاقتصادية للبلاد, فإن تنفيذها في بعض الأحيان يتطلب انتظام مجموعة من المؤسسات في إطار تجمع مؤقت, هذا التجمع المؤقت للمؤسسات يمكن أن يأخذ شكلين قانونيين, فإما أن يكون تجمع لمؤسسات متضامنة, أو تجمع لمؤسسات مشاركة. التشريعات الوطنية بما فيها التشريع الجزائري نظمت الإطار القانوني لهذا النوع من التجمعات عن طريق قانون الصفقات العمومية إن التنفيذ عن طريق التجمع للصفقات العمومية يسمح بتجنب صعوبات وسلبيات التنفيذ الفردي للمشاريع ذات الأهمية الوطنية.

Pour des raisons techniques ou économiques, le législateur a permettait aux entreprises contractantes en cadre des marchés publics et sous leur responsabilité de confier à une autre personne (le sous-traitant), après notification du maître d’ouvrage, l’exécution d’une partie du leur marchés conclues. Plusieurs conditions doivent être remplir avant que cette opération soit autorisée. La sous-traitance comme contrat représente un enjeu stratégique pour les différents acteurs de la vie économique. Vis avis l’importance des contrats des marchés publics dans la vie économique du pays, sa réalisation des fois nécessite une réunion des entreprises dans un groupement momentané appelé co-traitance. Ce groupement peut prendre deux forme, soit solidaire ou conjoint selon le cas. Les législations nationales y compris le législateur algérien, ont réglementés le cadre juridique de ce type de groupement d’entreprise à travers les codes des marchées publics. Ce mode de réalisation collectif des contrats permettre d’éviter les difficultés et les inconvénients de la réalisation individuelle des projets à une importance nationale.

For technical or economic reasons, the legislature allowed the contracting firms in the framework of public contracts and under their responsibility to entrust to another person (the subcontractor), after notification of the contracting authority, the execution of a part of their contracts. Several conditions must be met before this operation is allowed. Subcontracting as a contract represents a strategic challenge for the various players in the economic life. Vis views the importance of public procurement contracts in the economic life of the country, its realization of times requires a meeting of companies in a momentary group called co-contracting. This grouping can take two forms, either solidarity or spouse as the case may be. National legislations, including the Algerian legislator, have regulated the legal framework of this type of enterprise grouping through the codes of public markets. This collective embodiment of the contracts will make it possible to avoid the difficulties and disadvantages of the individual realization of projects of national importance.
