قاعدة اليقين لا يزول بالشك

Abstract

جاء هذا البحث في مقدمة وثلاثة مباحث ومداره حول قاعدة اليقين لا يزول بالشك وهي من كبرى القواعد الفقهية، والتي تدخل في جميع أبواب الفقه، كما يندرج تحتها قواعد أخرى تتعلق بها وتشخص معناها. أما من الناحية العملية التطبيقية، فقاعدة اليقين لا يزول بالشك تحتوي تطبيقات عدة، منها ما اتفق عليه وبعضها مختلف فيه بين المذاهب الأربعة؛ فنجد المالكية ينفردون في تطبيق بعض القواعد الفقهية عليها مخلفين في ذلك جمهور الفقهاء، وهذا يدل على أنهم يحكمون أصولا أخرى كالاحتياط والمصالح المرسلة وهذا ما حاولت الوقوف عليه في هذا البحث. إن قاعدة اليقين لا يزول بالشك ثبت أصل العمل بها من الكتاب والسنة واتفق عليه إجماعا، وهذا لا يعارضه شيء من الخلاف الذي وقع في بعض المسائل المخرجة عليها.
