المنهج الاستدلالي عند الشيخ عليش من خلال فتاويه

Abstract

يعتبر كتاب فتح العلي المالك في الفتوى على مذهب الإمام مالك لمؤلفه الشيخ محمد عليش المالكي الأزهري شيخ السادة المالكية من كتب الفتاوى التي دوَّنها أصحابها في العصر الحديث، ويدخل ضمن الصنف الذي لا يخرج في الحكم على مسائله عن روايات المذهب وأقوال المتأخرين وتخريجاتهم، استدل فيه صاحبه على جملة من المسائل، وقد يسترسل في بعضها بأصول لا تخرج عن أصول المالكية، وقد تميز في عرضه لها بتقديم الدليل القوي وإن لم يكن صريحاً أو خاصاً في المسألة، كما كان كثير النقل من كتب من سبقه مع إحالته تلك النقول الحرفية وهي الغالبة وما تصرف فيه منها، وهذه النقول الكثيرة هي سبب اختلاف الاستدلال عند الشيخ عليش، خاصة وأنه قد يقتصر على تلك النقول في الحكم على المسائل دون أي إضافة.
