مسالك الكشف عن مآلات الأفعال

Abstract

إنَّ مقصد الشرع من تنزيل الأحكام تحقيق مصالح العباد، ومآلات الأفعال هي نتيجة المترتبة على أفعال المكلفين و هي أصل مهم في الشريعة الإسلامية، إذ أن اعتباره يحقق مقصد الشرع فتطبيق حكم شرعي وتنزيله على المكلفين يجب أن يحقق مصلحة، لكن قد يحتاج المجتهد إلى طريقة يعلم من خلالها مآل فعله أو مآل تطبيق حكم شرعي ليصل إلى نتيجة توافق مقصد الشرع، وعليه فإن للمآلات الأفعال مسالك تعرف بها وهي كالتالي: مسلك فقه الواقع ومسلك استشرف المستقبل ومسلك الإسترشاد بقصد الفاعل
