Abstract

لقد تمحور موضوع المذكرة المعنون ب: "قواعد الأيمان من فروق القرافي ترتيب البقوري دراسة فقهية تأصيلية "، وقد ذكرت فيه ترجمة الإمام القرافي ومنهجه في كتاب الفروق ، ثم ذكرت ترجمة الإمام البقوري ومنهجه في كتاب ترتيب الفروق، ثم شرعت في شرح القواعد المذكورة في باب الأيمان، وهي ثمان قواعد كالتالي: 1. الفرق بين ما يجب توحيد الله به من التعظيم وما لا يجب توحيده به. 2. الفرق بين الصفات العلية التي تترتب عليها الكفارة والتي لا تترتب عليها 3. ما يوجب الكفارة من أسماء الله تعالى إذا حلف بها الحالف وما لا يوجبها 4. ما يدخله المجاز والتخصيص وما لا يدخله والمراد من ذلك الأيمان 5. ما تكتفي فيه النية في الأيمان وما لا تكتفي فيه 6. الفرق بين مخالفة النهي لما كان يقتضي التكرار ومخالفة اليمين لا يقتضي التكرار 7. الفرق بين ما تعذر عقلا من المحلوف عليه وبين ما تعذر شرعا أو عادة 8. وجه اختصاص المساجد الثلاثة بلزوم نذر المشي اليها دون غيرها ثم ذكرت الخاتمة وبينت فيها النتائج المتوصل إليها والحقت به الفهارس .
