المحتسب ودوره في رعاية البيئة

Abstract

لقد حظي موضوع رعاية البيئة بأهمية كبيرة في الشريعة الإسلامية، من خلال إقرار المبادئ والأسس التي من شأنها الحث والتأكيد على ذلك ؛ حيث أخذت بنظام الحسبة؛ الذي يعتبر نظاما رقابيا يقوم على فكرة الأمر بالمعروف و النهي عن المنكر. وقد نحى المشرع الجزائري المنحنى ذاته في مسألة الاهتمام برعاية البيئة ، باستحداثه وظيفة الضبط الإداري وتفعيله في مجال حماية البيئة التي منحها الله للإنسان تفضلاً منه ومنة.

Environmental protection has been given great importance in Islamic law, through the establishment of principles and foundations that encourage and emphasize this. This law adopts the Hisbah system, which is a regulatory system based on the idea of ​​enjoining good and forbidding evil. Algerian law has adopted the same approach to environmental protection, by creating the role of administrative control and activating it to protect the environment, which God has bestowed upon humanity as a favor and blessing
