سلطة رئيس الجمهورية في سن القانون في النظام الدستوري الجزائري

Abstract

توزع الدساتير الاختصاص بين السلطات استنادا وتجسيدا لمبدأ الفصل بين السلطات، لعدم تركيز السلطة بيد واحدة درءا للاستبداد بالرأي والاستئثار بالسلطة، وعلى رغم سداد المبدأ وصلاحه كأساس للديمقراطية، إلا أن واقع الحال محليا ودوليا أثبت صعوبة تجسيده نظرا لما استجد من معطيات جديرة بالاعتبار، وهو ما حتم إضفاء مرونة على المبدأ ليتحول إلى أمر تعاون وانسجام بين السلطات مبني على التوافق. والواقع أيضا أثبت عدم قدرة السلطة التشريعية مواكبة تطور وظيفة الدولة الحديثة وعجزها عن مواجهة مستجد الأزمات الاقتصادية والاجتماعية والسياسية في إيجاد الحلول بالسرعة المطلوبة، ما جعل من تدخل السلطة التنفيذية في مجال التشريع أمر ضروري نظرا لقدرتها على معالجة الأزمات وتقديم حلول فعالة في وقت قصير. والأصل اختصاص السلطة التشريعية بالتشريع، إلا أن الواقع ونتيجة التطور المطرد تطورت وظيفة السلطة التنفيذية فلم تعد تنفيذ القوانين وحسب، بل أصبحت شريك في التشريع بواسطة أدوات دستورية تمكن رأس الجمهورية المشاركة في سن القانون. ويجد رئيس الجمهورية مجاله في سن القانون في الظروف العادية وفي الحالات غير العادية، متى توفرت الشروط وتحققت الظروف المطلوبة، ويحوز مكنة التشريع بأوامر بشرط تحقق ظرف الاستعجال أو وجود ظرف استثنائي، وبيده سلطة الاعتراض التشريعي على القانون، ويختص بإصدار القانون، ويصدق على المعاهدات الدولية، كما يتحكم في تحريك الاستفتاء الشعبي وإقراره، فضلا سلطته على التعديل الدستوري.

In principle, the legislative authority has jurisdiction to legislate, But in reality, as a result of steady development, the function of the executive authority has evolved and is no longer merely implementing laws, But it is a partner in legislation through constitutional tools that enable the head of the republic to participate in enacting the law. The President of the Republic finds his place in enacting the law in normal and extraordinary circumstances, If the required terms and conditions are met, He has the authority to issue orders provided that there is urgency or an exceptional circumstance, He has the authority to veto the law, And the authority to issue the law, It ratifies international treaties, He initiates and decides the popular referendum, And the power of constitutional amendment
