https://dspace.univ-adrar.edu.dz/jspui/handle/123456789/9169 2026-04-09T07:17:41Z https://dspace.univ-adrar.edu.dz/jspui/handle/123456789/9267 التفسير الموضوعي عند طه جابر العلواني من خلال كتابه تفسير القرآن بالقرآن ونجلي, فاتح; مدياني, مصطفى / مؤطر شهدت حياة الدّكتور طه جابر العلوانيّ منعطفات حاسمة انعكست جليّاً على مشروعه الفكريّ في فهم وتفسير القرآن الكريم، فسلك منهج التّفسير الموضوعيّ في كتابه "تفسير القرآن بالقرآن"، وجاء هذا العمل ليقف على جهوده فيما يخصّ علم التّفسير الموضوعيّ، وليحدّد مداخل مشروعه، وليبرز أوجه اختلافه وتميّزه عن غيره من التّفاسير. ¤ عنوان الدّراسة: ترتبط هذه الدّراسة بالتّفسير الموضوعيّ وبمفسِّر من أبرز من فسّروا القرآن في العصر الحديث، وبكتاب تفسير حديث صدر مطلع العقد الجاري، فجاءت تحمل عنوان: التَّفْسِيرُ الْمَوْضُوعِيُّ عِنْدَ طَهَ جَابِرٍ العلوانيِّ مِنْ خِلَال كِتَابِهِ "تَفْسِيرُ الْقُرْآنِ بِالْقُرْآنِ" -الضَّوَابِطُ وَالْخَصَائِصُ- ¤ إشكالية الدّراسة: يرد موضوع هذه الدّراسة في سياق تناول أحد الجهود المعاصرة في توظيف التّفسير الموضوعيّ بروح جديدة، وينطلق من طرح الإشكالية التّالية: كيف صاغ طه جابر العلوانيّ من خلال كتابه " تفسير القرآن بالقرآن" مشروعه للتّفسير الموضوعيّ ؟ وإلى أيّ مدى استطاع أن يُقدّم رؤية منهجيّة واضحة تستوعب التّفسير الموضوعيّ ؟ ¤ أهمّ نتائج الدّراسة: - ارتبط تفسير طه جابر العلوانيّ بالأبعاد الإصلاحيّة والفكريّة والتّربويّة، فكان سياقه يتماشى مع واقع الأمّة وحاجاتها، ويدعو للتّزكية الشّاملة، وكان من نوع التّفسير الموضوعيّ. - يستوعب تفسير طه جابر العلوانيّ أغلب المقوّمات والخطوات المنهجيّة للتّفسير الموضوعيّ بأنواعه الثّلاثة، ويزيد عليه بمدخل الجمع بين القراءتين، وبناء المفاهيم والمصطلحات قرآنيّاً. - كشفت الدّراسة عن وجود ضوابط وخصائص للتّفسير الموضوعيّ عند طه جابر العلوانيّ. ¤ أهمّ توصيات الدّراسة: برزت للباحث خلال مرحلة قيامه بهذه الدّراسة عدّة موضوعات تصلح دراسات مستقبليّة حول تفسير طه جابر العلوانيّ، منها: السّياق عند طه جابر العلوانيّ من خلال تفسيره، المناسبات وأثرها في تفسير طه جابر العلوانيّ، التّفسير المقصديّ عند طه جابر العلوانيّ من خلال كتابه -تفسير القرآن بالقرآن-، التّفسير الفقهيّ عند طه جابر العلوانيّ من خلال كتابه -تفسير القرآن بالقرآن-، وغيرها من الموضوعات.; Taha Jaber Al-Alwani's life witnessed decisive turns that reflected clearly on his intellectual project in understanding and interpreting the Holy Qur'an. He followed the method of thematic interpretation in his book "Interpreting the Qur'an by the Qur'an". This work came to identify his efforts regarding the science of thematic interpretation, to define the approaches of his project, and to highlight its differences and distinctions from other interpretations. Title of the study: This study is related to thematic tafsir, one of the most prominenذ interpreters of the Qur'an in the modern era, and a recent book of tafsir published at the beginning of the current decade. The study is entitled: Thematic Tafsir with Taha Jabir Al-Alwani through his book "Interpretation of the Qur'an by the Qur'an" (Tafsir al-Qur'an by Qur'an) Conditions and characteristics. Problem of the study: The topic of this study comes in the context of addressing one of the contemporary efforts in employing objective interpretation in a new spirit, and it starts from the following question: How did Taha Jaber Al-Alwani formulate his project of objective interpretation through his book "Tafsir al-Qur'an by the Qur'an" and to what extent was he able to present a clear methodological vision that accommodates objective interpretation? Main Findings of the Study: Taha Jaber Al-Alwani's Tafsir al-Qur'an is associated with the Qur'an - Taha Jaber Al-Alwani's interpretation was linked to the reformist , intellectual and educational dimensions, so its context was in line with the reality and needs of the Ummah, and called for comprehensive optimization, and was of the type of objective interpretation. - Taha Jaber Al-Alwani's interpretation accommodates most of the components and methodological steps of the three types of thematic interpretation, and exceeds it by combining the two readings and constructing concepts and terms from the Qur'an. - The study revealed the existence of controls and characteristics of Taha Jaber Al-Alwani's thematic exegesis. Recommendations: During the course of this study, several themes emerged for future studies on Taha Jaber Al-Alwani's exegesis, including: Taha Jaber Al-Alwani's context through his interpretation, occasions and their impact on Taha Jaber Al-Alwani's interpretation, Taha Jaber Alwani's intentional interpretation through his book -Tafsir al-Quran by Quran-, Taha Jaber Alwani's jurisprudential interpretation through his book -Tafsir al-Quran by Quran-, and other topics. 2025-01-01T00:00:00Z https://dspace.univ-adrar.edu.dz/jspui/handle/123456789/9266 المقرب المستوفي في شرح فرائض الحوفي للإمام محمد بن يوسف السنوسي ت 895ه فلاح, الأزهر; دباغ, محمد / مؤطر تهدف هذه الدراسة إلى إبراز أحد أهم المؤلفات في علم الميراث لعلم من أبرز أعلام الجزائر في القرن التاسع الهجري، هذا الكتاب وهو المقرب المستوفي في شرح فرائض الحَوفي للإمام أبي عبد الله محمد بن يوسف السنوسي التلمساني، معتمدين في ذلك على 3 نسخ مخطوطة وهي نسخة المسجد النبوي، نسخة ميتشغان، نسخة المكتبة الوطنية الحامة الجزائرية، واعتمدنا على المنهج الوصفي والتاريخي محاولين إخراجها كما أرادها المؤلف أو قريبا من ذلك، حيث توصلت الدراسة إلى نتائج منها: أن هذا المخطوط يعتبر إبرازا للجانب الفقهي للإمام السنوسي باعتبار علم الفرائض مندرجا تحت علم الفقه، وهذا الجانب تمثل في اعتماد الشيخ على امهات كتب المذهب كالمدونة والبيان والتحصيل كما اعتمد على من أفرد التصنيف في هذا الفن كالعقباني والسّطي، كما لوحظ أن هناك تقارب كبير بين نسختي المسجد النبوي وميتشغان، كما توصي الدراسة بضرورة مواصلة البحث حول التراث الفقهي لعلماء الجزائر والاستفادة منه.; This study aims to highlight one of the most important works on the science of inheritance by one of the most prominent figures of Algeria in the ninth century AH. This book is Al-Muqarrab Al-Mustawfi fi Sharh Fara'id Al-Hufi by Imam Abu Abdullah Muhammad bin Yusuf Al-Sanusi Al-Tilimsani, relying on 3 manuscript copies: the copy of the Prophet's Mosque, the Michigan copy, and the copy of the National Library of Algiers.We adopted the descriptive and historical approach, trying to produce it as the author intended or close to it. The study reached results including: that this manuscript is considered a highlighting of the jurisprudential aspect of Imam Al-Sanusi, considering the science of inheritance as falling under the science of jurisprudence. This aspect was represented by the Sheikh’s reliance on the major books of the school of thought, such as Al-Mudawwana, Al-Bayan, and Al-Tahsil, as well as his reliance on those who dedicated themselves to classification in this art, such as Al-Uqbani and Al-Sati. It was also noted that there is a great similarity between the copies of the Prophet’s Mosque and Michigan. The study also recommends the need to continue research on the jurisprudential heritage of the scholars of Algeria and to benefit from it. 2025-01-01T00:00:00Z https://dspace.univ-adrar.edu.dz/jspui/handle/123456789/9265 الحق في الكفاية المعيشية وتطبيقاته الفقهية والقانونية بن زيطة, حسناء; موفق, طيب شريف / مؤطر تناول هذا البحث واحدا من أهم حقوق الإنسان الاجتماعية المرتبطة بكيانه وما يلزمه للعيش واستمرار حياته، وهو ما يُعرف بـ "الحق في الكفاية المعيشية" المنضوي ضمن الجيل الثاني لحقوق الإنسان والمعروف باسم جيل الحقوق الاقتصادية والاجتماعية والثقافية. فقد خلق الله الإنسان وكرّمه، ولحفظ تكريمه سهّل له سبل العيش الكريم، وأقر له حق الكفاف، فكان حق الكفاية المعيشية ملازما لتمام وكمال إنسانيته. وكذلك توالت الجهود الدولية التشريعية من خلال القانون الدولي لحقوق الإنسان لضمان الكفاية المعيشية وتخطي عتبة الفقر والقضاء على الجوع حفظا لإنسانية الإنسان. وقد تم تفصيل البحث ببيان مفهوم هذا الحق ضمن القانون الدولي لحقوق الإنسان، وتأصيل المصطلح في الفقه الإسلامي، ثم تتبع أسس مشروعيته ومؤيدات اعتباره في كل منهما، كل ذلك في الفصل الأول، أما الفصل الثاني فق تمّ من خلاله تفصيل أسباب وجوب الحق في الكفاية المعيشية، ثم تحديد العناصر التي يقوم عليها العيش الكريم. وقد خلصت الدراسة إلى جملة من النتائج، والتوصيات ذات الأهمية العلمية والتشريعية تؤكّد في مجملها أن حق الكفاية ضرورة شرعية وحقا إنسانيا ينبغي ضمان تحقيقه، كما فتحت آفاق البحث نحو جزئيات متعلقة بعناصر الكفاية المعيشية. 2025-01-01T00:00:00Z https://dspace.univ-adrar.edu.dz/jspui/handle/123456789/9258 تخريج الفروع على الاصول عند القاضي ابن عبد السلام الهواري المالكي ت 749ه في دلالات الالفاظ من خلال شرحه لجامع الامهات رجم, اسامة; بن دحمان, عمر / مؤطر لتخريج الفروع على الأصول أهمية كبيرة، وفوائد كثيرة؛ إذ يجمع بين الفقه وأصوله، وبه تظهر حاجة الفقيه إلى الأصول، وحاجة الأصولي إلى الفقه، وبه تظهر ثمرة الأصول، وكيفية استثمارها؛ لذلك أفرده العلماء بالتصنيف، وأولوه اهتماما كبيرا. هذا البحث تسليط للضوء على جانب تخريج الفروع على الأصول عند شخصية علمية ذات أهمية بالغة جدا، وقيمةٍ عالية في صرح الفقهاء المالكية. بعد التعريف به، والإشهار لمكانته وعلمه، ثم التعريج على مهمات في تخريج الفروع على الأصول لا بد منها. وقد ظهر أن تلك الشخصية اعتمدت تخريج الفروع على الأصول وسيلةَ شرح وتقرير، وتوجيه، وتعليل، وترجيح، وظهر لها رسوخ كبير في علمي الفقه وأصوله، وتفنن كبير في استثمار القواعد الأصولية على مختلف المذاهب، كما ظهر بعدها عن الجمود الفكري، والتعصب المذهبي؛ فكانت شخصية حرية بمزيد من الدراسات والبحوث، في شتى الجوانب العلمية الأخرى. تلك الشخصية هي: قاضي الجماعة أبو عبد الله محمد بن عبد السلام الهواري التونسي المالكي (749ه); Derivation of branches from foundations has crucial significance and several benefits, as it combines jurisprudence and its principles. It shows the need of the jurist to the principles and the need of the principles scholars to jurisprudence. Indeed, derivation reveals the advantages of the principles and how to employ them. Therefore, scholars dedicated special classification to it, as well as significant importance. This research aims to shed light upon the aspect of deriving branches from principles by a highly significant and esteemed figure in Maliki jurisprudence. After introducing his profile and highlighting his status and knowledge, the study covers essential aspects of deriving branches from principles. It has become clear that this scholar relied on derivation of branches from principles as a means of explanation, elucidation, guidance, justification and preference. He demonstrated a strong mastery in Islamic jurisprudence and its principles, along with a significant creativeness in applying foundational rules across various schools of thought. It was shown that he avoided intellectual stagnation and sectarianism. This has rendered him a personality deserving of further investigation and research in various scientific disciplines.
