Islamic banks in Algeria are considered modern compared to other traditional banks. It faces several challenges, and perhaps among these problems and challenges is the lack of understanding of those dealing with Islamic banks about the nature of the work of these banks, which has led to confusion between the Islamic finance system and traditional finance, which has made many people question the work of Islamic banks, and believe that the matter is merely fraud and... Islamic banking is just hidden usury. To answer this problem, we studied the Islamic banking contracts applied at the level of the Algerian banking system, case by case, and analyzed the contractual clauses they contain, to determine the extent to which these terms are compatible with the provisions of Islamic Sharia. We have found the following: 1/ The tendency of Islamic banking in Algeria to exaggerate the demand for guarantees and mortgages, which narrows the opportunities for benefiting from financing for many segments of society. 2/ The conditions that Islamic banks in Algeria set with the customer serve them more than they serve the customer, and this is what makes customers resort to other methods that may be un-Islamic. 3/ Islamic banks in Algeria committed some Islamic violations, especially in leasing contracts ending with ownership. |
