ونتيجة عدم فاعلية الرقابة السياسية على دستورية القوانين، وتأثرا بالتوجه العالمي في الأخذ بالرقابة القضائية خاصة بعد تحول دول المغرب العربي (المغرب 2011، تونس 2014) فقد تحول المؤسس الدستوري الجزائري من نموذج الرقابة السياسية على دستورية القوانين إلى الرقابة القضائية بموجب التعديل الدستوري الأخير لسنة 2020 وذلك بالنص على استحداث محكمة دستورية تعنى بضمان احترام الدستور وضبط سير المؤسسات ونشاط السلطات العمومية خلفا للمجلس الدستوري. emocratic systems with semi -rigid constitutions depend on the system of censorship on the constitutionality of laws in order to achieve the principle of the constitutional base for other minimum rules, and to protect the rights and general freedoms of individuals constitutionally guaranteed from any attack, as these democracies are accustomed to this on two traditional models: political and judicialcontrol. Since its independence, Algeria has taken itself, and in most of its constitutions (with the exception of the 1976 constitution) with the system of control over the constitutionality of laws, it has inherited from the French colonizer the model of political control by stipulating the establishment of a constitutional council entrusted with the task of controlling the constitutionality of laws. The Algerian constitutional founder, through successive constitutions and subsequent constitutional amendments, tried to reform the Foundation for Control over the constitutionality of laws by enhancing the independence of this institution and the independence of its members from the bodies that they appointed or elected, and to provide the necessary guarantees to achieve greater effectiveness in performing its tasks. As a result of the lack of effectiveness of political control over the constitutionality of laws, and affected the global trend in taking judicial supervision, especially after the transformation of the Arab Maghreb countries (Morocco 2011, Tunisia 2014), the Algerian constitutional founder has shifted from the model of political control over the constitutionality of law Constitutional. |
