This dissertation studies and analyzes the penal system in Mozabite society between the 15th and 19th centuries, as a local experience that combined Ibadite legal references, social particularities, and traditional institutions. The research problem was framed around several questions: What is the nature, foundations, and components of this system? What characteristics shaped its punitive mechanisms? How did its legal and customary references interact in the construction of its framework? To what extent does it converge with or diverge from Ibadite Islamic law and the Algerian Penal Code? And finally, to what extent can its elements contribute to contemporary debates on alternative sanctions and criminal policy? To answer these questions, the research adopted a historical, legal, and comparative approach, combining conceptual grounding, the study of Mozabite social and organizational structures, and the analysis and classification of sanctions and their modes of application, before comparing them with Islamic law and the Algerian Penal Code. The findings revealed that the Mozabite penal system was not merely improvised customs, but a structured framework based on written agreements, collective councils, and a strong legal reference. Symbolic and financial sanctions proved more effective and impactful than corporal punishments, due to their collective legitimacy and the speed and publicity of their execution. The study concludes that, although this experience lacks certain procedural safeguards of modern justice, it remains a valuable resource that can enrich debates on alternatives to imprisonment and on restorative justice, provided it is reintroduced within a contemporary legal framework that upholds rights and freedoms.
