الضبط القانوني للتطبيقات الذكاء الاصطناعي ودوره في مكافحة جرائم تبيض الا موال

Abstract

تسلط هذه الدراسة الضوء على التحديات والتداعيات التي يواجهها المشرعون وكذا المحاكم، في تنظيم استخدامات الذكاء الاصطناعي المنتشرة باضطراد في مختلف المجالات والممارسات الحياتية، فمن خلال تناول بعض الدراسات القانونية على سبيل المثال لا الحصر عن استخدام الذكاء الاصطناعي، وبالإضافة إلى السوابق القضائية المتعلقة به ، وكذا بعض أحكام وقرارات المحاكم التي تناولت قضايا خاصة بالذكاء الاصطناعي، تبرز الأهمية المتزايدة لهذه التكنولوجيا الذكية في النظام القانوني، والقضايا المعقدة المتعلقة بتنظيمه ومسؤولياته، فكان السعي إلى معالجة الآثار الناجمة عن الاستخدام المتسارع لهذه التقنيات الذكية، بما هو متاح من قواعد قانونية وأحكام وقرارات قضائية مقارنة محاولة للتكييف معالجة هذه الآثار مع البيئة القانونية الحالية. فمحاولة ضبط استخدامات الذكاء الاصطناعي من خلال تطبيق القواعد القانونية المتاحة في وقت سابق وفي الحاضر، الهدف منه التحكم وضبط هذه الأنظمة الذكية حتى لا تخرج عن السيطرة، فتخلف بذلك أضرار تمس بحياة البشر، حتى ولو كان ذلك نسبيا من حيث التخفيف من هذه المخاطر ومعالجتها، مما يسمح كذلك بإقرار وسن قواعد قانونية خاصة في المستقبل من ناحية، وتشجيع الابتكار من ناحية أخرى، وهذا ما يدفع بأهل الاختصاص القانوني والقضائي وكذا الهيئات العالمية والإقليمية إلى الاستجابة الملحة لسن قواعد قانونية تلائم الطبيعة الخاصة لهذه التقنيات الحديثة، ومن ثم الوصول إلى وضع إطار قانوني شامل ينظم دورة حياة هذه الأنظمة الذكية، هذا الإطار الذي من شأنه ضبط كل أنشطة هذه الكيانات الاصطناعية، من معالجات للمخاطر الناجمة عنها، وكذا تعزيز الأدوار الإيجابية المتعددة لها كاستخدام الذكاء الاصطناعي في مجابهة جريمة تبييض الأموال، فبقدر التطور العلمي في هذا المجال التكنولوجي تتطور الجرائم المرتكبة بواسطة هذه التكنولوجيا، مما يضع المشرع موضع المجبر والملزم للبحث عن وسائل قطع الطريق أمام هذا النوع من الجرائم وغيرها.

This study highlights the challenges and implications faced by legislators and courts in regulating the increasingly widespread use of artificial intelligence in various fields and life practices. By examining some legal studies, including but not limited to the use of artificial intelligence, in addition to relevant case law, as well as some court rulings and decisions that addressed issues related to artificial intelligence, the growing importance of this smart technology in the legal system and the complex issues related to its regulation and responsibilities are highlighted. The study sought to address the effects resulting from the accelerated use of these smart technologies, using available legal rules, comparative judicial rulings, and decisions, designed to adapt these effects to the current legal environment. The attempt to regulate the use of artificial intelligence by applying the legal rules available in the past and present aims to control and regulate these smart systems so that they do not get out of control, causing harm to human lives, even if this is relatively limited in terms of mitigating and addressing these risks. This also allows for the adoption and enactment of specific legal rules in the future, on the one hand, and encouraging innovation, on the other. This is what prompts legal and judicial specialists, as well as global and regional bodies, to urgently respond to the enactment of legal rules that suit the special nature of these modern technologies, and then arrive at a comprehensive legal framework that regulates the life cycle of these smart systems. This framework would regulate all the activities of these artificial entities, from addressing the risks they pose, to enhancing their multiple positive roles, such as the use of artificial intelligence to combat the crime of money laundering. As scientific developments in this technological field evolve, crimes committed using this technology evolve, which forces the legislator to seek ways to block this type of crime and others.
