مكافحة الفساد في مجال الصفقات العمومية

Abstract

تتناول هذه الدراسة المنظومة القانونية لمكافحة الفساد في مجال الصفقات العمومية في التشريع الجزائري، في ضوء التشريعين الفرنسي والمصري والمعايير الدولية ذات الصلة. وتهدف إلى تقييم مدى كفاية الإطار التشريعي في تحقيق مكافحة فعالة للفساد، وقد خلصت إلى أن هذه الفعالية تقتضي منظومة قانونية متكاملة تقوم على تكامل القواعد الموضوعية والإجرائية مع الآليات الوقائية والرقابية والمؤسساتية والجزائية، بما يعزز حماية المال العام ويكرس مبادئ الشفافية والنزاهة، ويحقق مواءمة التشريع الوطني مع المعايير الدولية.

This study examines the legal framework governing anti-corruption in public procurement under Algerian law, in light of the French and Egyptian legal systems and the relevant international standards. It seeks to assess whether the existing legislative framework is sufficient to ensure effective anti-corruption in public procurement. The study concludes that effective anti-corruption requires a comprehensive and integrated legal framework founded on the coordination of substantive and procedural rules with preventive, supervisory, institutional, and criminal enforcement mechanisms. Such an approach strengthens the protection of public funds, reinforces the principles of transparency and integrity, and promotes the harmonization of Algerian legislation with international standards.
