الأجل القضائي في الفقه الإسلامي

Abstract

إن من مهمات القاضي الاجتهاد في التمييز بين المدعي والمدعى عليه، وكذلك في جمع الأدلة، والتحري في ذلك، ومعرفة المقبول منها والمردود، وكذاك في إعطاء الأجل في كل فصل من فصول الخصومة المعروضة بين يديه إذا احتيج له، و الأجل في الإجراءات القضائية مشروع وهو حق الخصم إذا طلبه بشرط عدم المماطلة، وللقاضي أن يسير على ما نص عليه القضاة والموثقون إن وجد لذلك وجهاً، وهو للقاضي أو من في حكمه، و السلطة التقديرية للقاضي تجيز له أن يمنع الخصم من الأجل إذا استبان له موجبه؛ لأن ما يؤديه إليه اجتهاده يكون في مصلحة القضاء. وما ينهي المخاصمة والنزاع، وتبرز أهمية ما نص عليه الفقهاء من الإعذارات وأنواع التأجيلات عند اجتهاد القاضي في إعمالها حكماً وتنفيذاً.

it is the judge’s duty to strive to distinguish between the plaintiff and the defendant, as well as to collect evidence, investigate it, and know what is acceptable and what is rejected, as well as to give a deadline in each chapter of the dispute presented to him if it is needed, and the deadline in judicial procedures is legitimate and is the right of the opponent if he requests it on the condition that there is no procrastination, and the judge may proceed according to what the judges and notaries have stipulated if there is a reason for that, and it is for the judge or someone in his position The judge's discretionary power allows him to deny a party the deadline if he finds it justifiable, as his discretion serves the interests of the judiciary and resolves disputes and conflicts. The importance of the warnings and types of postponements stipulated by jurists becomes apparent when the judge uses his discretion to implement them as a ruling or execution.
